Terms of Service
1. General
1.1. Owner of the Service
The RewardsWallet Service and the RewardsWallet Web Site are owned and operated by Unified Incentives Pty Ltd (referred to hereafter as 'RewardsWallet', 'we', 'us' or 'our').
1.2. Acceptance of the Terms of Service
Your use of the Service is conditional upon your express agreement to, acceptance of and compliance with these Terms of Service, as well as agreement to and compliance with other terms, conditions, notices and disclaimers contained elsewhere on the RewardsWallet Web Site. Your first use of the RewardsWallet Service constitutes your acceptance of these Terms of Service.
1.3. Changes to the Terms of Service
We reserve the right to vary these Terms of Service by providing 30 days notice on this website. Because as a user of the Service you will continue to be bound by these Terms of Service, you should periodically refer to them here to review any changes.
1.4. Changes to the Service
We reserve the right to vary the specifications, rewards, rules, conditions and content of any aspect of the Service and Web Site at any time without notice.
1.5. Content of the Web Site
Whilst we make every effort to ensure information or content published on the Web Site by us is accurate and complete, we make no guarantee that it is, and cannot be held responsible for any errors or omissions in any such information or content. Any dated information or content published by us on the Web Site is current at the time of publication, and we are not obliged to update or amend any such information or content.
2. Eligibility and Conditions of Use
These conditions of use are the primary, but not the only conditions of use. We reserve the right to terminate your use of the Service if you breach or fail to comply with any of the following conditions of use:
2.1. Accuracy, honesty and integrity
At all times in your dealings with RewardsWallet and its partners and suppliers you must act with integrity and honesty.
2.2. Unlawful use, hacking, tampering and using automated scripts
2.2.1. You must not use the Web Site or Service in a way that is or for any purpose that is unlawful.
2.2.2. You must not use the Web Site to engage in any kind of hacking, tampering, spoofing or abuse of any system or computer network.
2.2.3. You must not engage in any kind of hacking, tampering, spoofing or abuse of the RewardsWallet Web Site and any aspects of the Service.
2.2.4. You must not use a script, robot, software program, or other system that operates the Web Site or Service on your behalf and outside of the intended use of the Web Site or Service, whether it be to click links automatically, or otherwise interfere with the normal operation and security of the Web Site or Service.
2.2.5. If you breach any of the conditions above, your RewardsWallet balance will be forfeited and you may be prosecuted for damages or expenses arising directly or indirectly out of your actions.
2.2.6. We are under no obligation to monitor any person's use of the Web Site or Service, however we reserve the right to monitor the Web Site and Service and retain and disclose information as allowed by law and requested by any law enforcement authority in any jurisdiction.
3. Privacy and Security
3.1. Privacy
We take the security and privacy of your personal information very seriously. RewardsWallet has a Privacy Policy which should be read in conjunction with these Terms of Service.
3.2. Email Address
3.2.1. Your email address may be shared with a third party if it is required by law. For example, if we receive a lawful direction or request from a law enforcement authority in any jurisdiction we may disclose your email address to that authority.
3.2.2. Your email address may be shared with a third party (for example a supplier or partner of ours) if it is necessary for us to process a transaction that you request us to process, or if you opt-in to a service or feature where we outsource some aspects of the provision of that service or feature. For example, if you request to redeem your rewards for an electronic gift card, we may share your email address with a rewards processing company that sends the reward to you on our behalf. In all cases where your email address is shared with a third party, the sharing of such information is covered by strict legal agreements that prevent the third party from using that information more than once, or for any purpose beyond what is allowed for in the agreement.
3.3. Security
We will take all reasonable precautions and measures to maintain the security and privacy of your personal information. This includes using the very best in hardware, software, and security practices available to us. However, due to the nature of the Internet and the nature of the systems and technology available at the current time, it is unfortunate that breaches of security are still possible. Therefore we cannot guarantee that your information will be completely secure, and we cannot be held liable for any loss or damage arising out of a breach of security.
4. Communications from Us
4.1. We will notify you via email when a RewardsWallet third party client allocates rewards to your email address. This notification is sent on behalf of the third party client and is initiated by the third party client, and the third party represents to us that they have an existing relationship with you and therefore have your consent to send you email. An example of this is that you are a member of the third party's web site, or you are a customer of the third party.
4.2. You may unsubscribe from receiving emails from RewardsWallet by terminating your use of the Service and using the Unsubscribe link in the footer section of any email we send to you. By unsubscribing, you are indicating your preference to never be notified by email if any RewardsWallet third party client allocates rewards to your email address. After unsubscribing, you may still claim and redeem your rewards by using the Check Balance feature on the RewardsWallet Web Site.
5. Redeeming Rewards
5.1. To redeem rewards from your RewardsWallet, you will need access to the email address associated with that RewardsWallet balance. This is because, without any other identifying information or any other method to verify identity, the only method to verify the owner of a RewardsWallet balance is via email verification. If you lose access to your email address, you will also lose access to your RewardsWallet rewards balance associated with that email address.
5.2. RewardsWallet allows you to redeem your rewards for an electronic gift card (egift card), delivered via email, once you have accumulated at least the minimum value required for redemption. This minimum redemption value varies depending on the country of redemption, and is shown on your RewardsWallet balance and redemption page. Egift cards can only be redeemed in the denominations available on the balance and redemption page. Any value left in your RewardsWallet balance after redemption will remain and be available for future redemption once the minimum value for redemption is again achieved.
5.3. The egift card you will receive for your redemption is issued by GiftPay.com. Treat your egift card as cash. Any person who learns the URL of your egift card can use it, therefore it is your responsibility to keep your egift card safe by keeping the URL private. We recommend you keep the original egift card email safe and take all measures necessary to secure your email. Do not open your egift card on a public or shared computer terminal. Lost or stolen egift cards will not be replaced or refunded. Not redeemable for cash. When you choose to redeem your egift card by converting part or all of the value into a participating merchant's egift card or voucher, the validity of that portion of your egift card will change to a shorter period. Please pay attention to the expiry periods and dates shown. Any unused value after the expiry date of any egift card or voucher will not be refunded or credited. When you convert value into a participating merchant's egift card or voucher, the conversion is final and cannot be reversed. Egift cards and vouchers are not reloadable.
6. Copyright
All content and material on the RewardsWallet Web Site and sent to you in an email by RewardsWallet is protected by Australian and international copyright law, and may also be protected as a trademark, service mark, or under other rights and laws. Except for the creation of a temporary copy on your computer which is inherent to the process of the normal use of the Web Site or Service, the content and material referred to above may not be copied, reproduced, published, stored in a retrieval system, altered or otherwise used in any form or by any means, in whole or in part, without our prior written approval, or the approval of the relevant copyright owner.
7. Disclaimer of Warranty
You acknowledge that you have not relied upon or been induced by any representation by us and that we make no warranty or representation as to:
- the results that may be obtained through subscription of the Service;
- the accuracy, reliability or otherwise of any information obtained through subscription of the Service;
- the financial or other rewards which may be obtained through subscription of the Service;
- the Service or Web Site being uninterrupted, timely or error free;
- the goods and/or services purchased or obtained through the Service or Web Site, including goods and or services offered by third parties, except where expressly indicated.
8. Limitation of Liability
You release RewardsWallet, its parents, subsidiaries, and its officers, employees, agents and affiliates from any claim for loss, damage or liability, including special indirect or consequential loss or damage such as loss of revenue, unavailability of systems or loss of data, in respect of:
- any advertising emails or survey invitation email sent to you;
- your subscription of the Service;
- your use of or inability to use the RewardsWallet Web Site;
- the quality of goods and/or services purchased by you;
- any dispute with a supplier of goods and/or services.
9. Indemnification
You indemnify and keep indemnified RewardsWallet, its parents, subsidiaries, and its officers, employees, agents and affiliates against all claims (including third party claims), demands, damages, costs (including legal costs), penalties or suits caused by or arising out of or consequential upon your use of the Service or Web Site.
10. Termination
10.1. Termination
These Terms of Service are effective and in force until terminated by us. We may terminate these Terms of Service at any time without notice.
10.2. Cancellation by Us
We reserve the right to cancel your RewardsWallet balance and terminate your use of the Service at any time, without cause or reason, and without notice. Specifically, we may cancel your balance and terminate your use of the Service, without notice, if you:
- breach or violate any conditions or requirements in these Terms of Service;
- act against the business interests or reputation of RewardsWallet or its affiliated organisations and clients.
10.3. Non-use
We reserve the right to cancel your RewardsWallet balance and terminate your use of the Service if you do not have rewards allocated to you, redeemed by you, or if you do not check your RewardsWallet balance, at least once every 24 months.
10.4. Cancellation by you
You may choose to terminate your obligations under these Terms of Service at any time by cancelling your subscription of the RewardsWallet Service. This can be done using the Unsubscribe link in the footer section of any email we send to you. You should also notify any third parties that issue rewards to you via RewardsWallet of your request to terminate your use of RewardsWallet.
10.5. Cancellation is final
If your RewardsWallet balance is cancelled, the cancellation is final and your balance cannot be re-activated.
10.6. Forfeit of rewards
If your RewardsWallet is cancelled, you will forfeit all outstanding gift cards, payments and rewards.
10.7. Refusal of subscription
We reserve the right to refuse your request to subscribe to the Service again if we have ever cancelled your subscription of the Service in the past.
11. Severability
If any part of these Terms of Service is or becomes illegal, invalid or unenforceable, it shall not affect the validity or enforceability of any other part or provision of these Terms of Service.
12. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New South Wales and of the Commonwealth of Australia. You submit to the jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
